1. ACCEPTANCE OF TERMS 

Welcome to mojohtx.com (the “Site”). These Terms of Use (“Terms”) constitute a legally binding agreement made between you and Mojo Hospitality Group LLC, doing business as Mojo Hookah Lounge (“Company”, “we”, “us”, or “our”), located at 3015 Bagby St, Houston, TX 77006, concerning your access to and use of the Site and any related services. By accessing the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree, you are expressly prohibited from using the Site.


2. AGE RESTRICTIONS 

The services available on the Site, as well as access to our venue, are strictly limited to individuals of legal age. You must be 21 years of age or older to consume tobacco or alcohol. By using the Site to make a reservation, purchase, or inquiry, you represent and warrant that you are of sufficient legal age to create legally binding obligations for any liability you may incur as a result of your use of the Site.


3. RESERVATIONS, PURCHASES, AND VENUE POLICIES

  • • Reservations: All reservations made through the Site are subject to availability and confirmation.
  • • Gratuity: Please note that a 20% gratuity is automatically added to parties of 6 or more at our Houston location.
  • • Check-In Policy: We reserve the right to release your table or reservation if you fail to check in within the designated grace period on the date of your reservation.
  • • Menu & Hours: The full kitchen operates until 11:00 PM; a restricted late-night food menu operates from 11:00 PM until close.


4. INTELLECTUAL PROPERTY RIGHTS 

The Site and all of its content, including but not limited to data, text, designs, menus, images, photographs, audio, video, and software, are owned by or licensed to Mojo Hospitality Group LLC. You may not copy, reproduce, distribute, or create derivative works from our content without our express prior written permission.


5. PROHIBITED ACTIVITIES 

You agree that you will comply with all applicable local, state, and federal laws in your use of the Site. You are specifically prohibited from:

  • • Using automated software (bots, spiders, etc.) to scrape data, make fraudulent reservations, or obtain discount codes.
  • • Submitting false, misleading, or defamatory information.
  • • Interfering with or disrupting the security or performance of the Site.
  • • Using the Site for any unlawful purpose under the laws of the State of Texas or the City of Houston.


6. DISCLAIMER OF WARRANTIES 

YOU AGREE THAT YOUR USE OF THE SITE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, THE SITE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


7. LIMITATION OF LIABILITY 

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MOJO HOSPITALITY GROUP LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR VENUE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


8. INDEMNIFICATION 

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of your use of the Site or breach of these Terms.


9. GOVERNING LAW AND DISPUTE RESOLUTION (TEXAS)

  • • Governing Law: These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Texas applicable to agreements made and to be entirely performed within the State of Texas, without regard to its conflict of law principles.
  • • Venue & Jurisdiction: Any legal action or proceeding related to your access to or use of the Site shall be instituted exclusively in the state or federal courts situated in Harris County, Houston, Texas. You agree to submit to the personal jurisdiction of, and agree that venue is proper in, these courts.
  • • Arbitration: At our sole discretion, we may require you to submit any disputes arising from the use of these Terms or the Site to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association, applying Texas law.


10. CHANGES TO THESE TERMS 

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
